The Courts of Massachusetts Became the Get-Away-Drivers for Serial Fraud by Banks

Dear Representative:

The courts of Massachusetts became the get-away-driver for serial fraud that was perpetrated upon me by a series of Massachusetts's banks. The courts apparently agreed with law firms representing the banks and collection company that all lying, deception and extortion by the bank and the collection agency were irrelevant. The courts apparently agreed with law firms representing the banks and collection company that a signature, no matter how forced and extorted, was all that is necessary to eliminate my constitutional right to bring the bank and collection trial before a jury to answer to the complaint of serial deception, fraud and extortion.

The truth in lending laws, and section 93A of the Massachusetts State law have no applicability to commercial loans. After pounding the streets of Boston looking for a lawyer that would tell me otherwise, I proceeded through all the courts of Massachusetts looking for a judge that would give me a jury trial for the bank fraud. The Superior Court wouldn't grant me my 7th Amendment right to a trial by jury. The Appeals Court, the Supreme Judicial Court of Massachusetts and the Federal Court of Massachusetts wouldn't grant me 7th Amendment right to a trial by jury.

On the lobby walls of the First Federal Court in Boston there is an etched phrase that states that: "Justice is a consideration of Truth and Facts". This same court, however, did not allow me the discovery process which would have allowed me to subpoena documentation that would prove that the bank's initial fraud caused me to lose my entire net worth and life savings of a half million dollars. The courts sided with the serial liars and decided not to allow the discovery of any facts, which would prove my case and perhaps even prove other highly suspicious acts of extortion (like the loss of three jobs in three months due to anonymous calls by the collection company). So much for the engraved saying that "Justice is a consideration of truth and fact". I found that American Justice does not consider truth or fact.

Apparently, banks are completely irresponsible for telling the truth. My banker even laughed at the truth. "Don't feel bad", he said, "We lie to everyone, not just you!"

You have no signed agreement with your lawyer. All you have are verbal assurances. Should your lawyer screw up or lie to you, you’re f----d.

Think that the Judicial Misconduct Board or the Lawyer Misconduct Board, or the Attorney General, or the Banking Commissioner will help? Think again. They all follow former President Reagan's rule: "Bureaucracy exists to protect Bureaucracy". The banks are part of that bureaucracy. You are not.

If you take out a commercial loan remember: "If you lie, you will go to jail for fraud. If your bank lies, you may lose everything and then some." The Bill of Rights and many laws are fraudulent in that they give you a false sense of security. The banks can be completely irresponsible: the banks are the establishment. You are food for the banks and the lawyers.

The referenced investment was a 12-unit apartment building in Fall River that was purchased for $525,000 in 1986. In 1996, the building was taken from me and sold for $180,000. I still owed $360,000 on the building. My house was attached for the outstanding difference.

I even went out of state to work and pay for the building. I paid up to 14% in interest rates. I was virtually not allowed to get another loan, to sell, or to condominiumize the property. I held on the longest of any of the 12 unit buildings built in the area. I made the most income for the banks. I was rewarded by an attachment on my home. I never made a profit. All my profit went towards property improvements. Ten years of hard work were wasted in addition to $200,000 and the lost interest on that money over ten years.

To get a jury trial would have cost me my earnings over several years as well as forgoing any equity appreciation on my home. Had I won that trial, against wealthy and knowledgeable legal firms, I would have won the right to collect from a limited partnership, which has no assets. They would then have declared bankruptcy leaving me with the ownership of a worthless partnership and nothing but more grief. In other words, the system gave me little chance for justice. I had slim chances of profiting from litigation.!

The only reason I bought the property was because the bank lawyers removed all references to my home and real estate from the guarantee. Ten yeas later, the lady judge thought for a couple of seconds after reading my objections to a lien on my home and decided that "Everybody knows a guarantee extends to real estate." After only a moment's hesitation, she put a $200,000 attachment on my home and gave the 12-unit building back to the banks. The request for a jury trial was denied then as well as several times later.

I was punished twice for the initial bank deception. I was punished initially by the inducement to by a property that was destined to fall. The courts punished me a second time when they rewarded the bank for their fraud and deception by virtually giving my home, as well as the 12-unit building, to the defrauding banks. I was punished a third time when the courts refused to grant me any opportunity for a jury trial when I tried to sue for the fraud and deception.

The courts gave a one-sentence reason for denying me a jury trial: they said they ostensively agreed with the lawyers of the people who committed the fraud, extortion and deception.

I petition three things of government:
1. Government should compile a list of people injured by government actions (whether caused by negligence or good intentions). The list should specify the amount of the damage and how injured.
2. Government should really give the people their 7th amendment right to a jury trial even if it makes it possible to bring suit against banks, lawyers, police or other government agencies.
3. Stop legalizing fraud and swindles for lawyers!

America has no justice System; Americans have a legal system. A justice system requires morality, fairness, truth and facts.

The word justice is defined as the principle of moral rightness. Justice is a legal decision influenced by principles of ethics and fairness.

The word legal is defined as recognized or enforced by law rather than influenced by principles of ethics and fairness.

A legal system makes decisions such as the Dred Scott Case. The Dred Scott Case was decided just before the American Civil War. In this decision, it was decided that slaves didn't have the right to freedom because: "slaves were property and the U.S. Constitution forbade Congress to deprive persons of their property without due process of law1"

A true justice system would start with the bill of rights in the constitution minus the Slavery Amendments. A fairness doctrine or consideration would be added: "If loss or suffering was produced by deception, force or negligence, then restitution should be proportional to the both the loss and the degree to which the loss was influenced."

Moral codes are simple. However, the legal system is a bunch of get-rich-schemes all disguised as law and hidden within thousands of volumes of convoluted text. The above mentioned Dred Scott Case was a get-rich-scheme in that it legalized slavery so that slave owners could get wealthy.

Please give Americans a justice system by insisting that all court decisions must comply not only with the law, but with the constitution and a fairness principle (as described above). All trials should be a double-edged sword if counter complaints exist. Hearing one side without hearing the other never has and never will produce justice. If the Police bring charges against a citizen, then the citizen has a right to bring charges of police brutality against the arresting officer at the same time.

Police Brutality exists because of the heavy discrimination in favor of government and the police by the court systems. It is extremely difficult to bring a police officer to trial for police brutality.

Police that commit acts of police brutality needn't be crucified, but the crime they have committed should be acknowledged and penalized by government. Police Brutality exists because of government negligence and discrimination against all Americans white and black, male and female. Americans are people, not the property of the state! We have rights too!
